A federal judge appointed by President Trump has ruled that the Trump administration must end a policy that effectively bars most Central American migrants fleeing poverty and persecution from obtaining asylum in the United States.

The asylum rule in question prevents migrants from gaining protection in the United States if they fail to first apply for protection in a country en route to the southwest border. But Judge Timothy J. Kelly of the U.S. District Court for the District of Columbia said late Tuesday night that the Trump administration illegally put in effect the rule by not allowing the public to weigh in on it. The administration had argued that allowing for a public comment period after announcing the rule would have prompted migrants to rush to the border, a claim Judge Kelly did not accept.

The ruling was only the latest in a string of defeats the Trump administration has been dealt by judges who decided that administration officials, in their haste to make policy, violated federal law laying out how regulations must be carried out or rolled back. The Supreme Court last month preserved Obama-era protections for about 700,000 young undocumented immigrants known as Dreamers, ruling that the administration had violated procedures in rolling back the rule.

In April, an effort to roll back nutrition standards for school mealschampioned by former first lady Michelle Obama, was reversed on similar procedural violations. In the environmental arena, federal courts have found at least five times that the Trump administration violated the Administrative Procedure Act by skipping steps when it tried to delay conservation rules that had already taken effect.

The same factors may have cost the president his hard-fought rule to block asylum seekers.

“It’s notable in this case that Judge Kelly reiterated what other judges recently retorted to the administration: Do your homework,” said Claudia Cubas, litigation director for the Capital Area Immigrants’ Rights Coalition, one of the plaintiffs in the lawsuit.

Ha ha... they're not really details people. Well obviously Trump isn't but he's got rid of so many and replaced them with yes men that it seems there is no-one who understands the machinery of government left. It's fine to not be good on the details as long as those below you can fill them in but it seems they can't even do that... didn't Trump say "Who would have thought health care was so complicated?" when he couldn't magically fix it a couple of years back?

I saw this earlier. It's a slightly confusing story though isn't it cos it's not necessarily linked to the rally. I read it to be that random people who have been tested in the last few days have all tested positive... it could in fact be nothing to do with the rally right? Though it's probably a factor in some cases.

I choose to believe that it's because of the rally, and the sorts of people who love Trump enough to attend his ridiculous Caliguloid ego-wank sessions all think it's a hoax anyway, so it's karmically satisfying. (Sucks for non-Trumpists who've caught it from them, of course.)

Usually I'd be sceptical, but Trump and his gang are just so far outside the normal order of things that it doesn't strike me as implausible.

We really aren't in Kansas any more, Toto.

So, with the supreme court cases, it seems that SDNY can access Trump's taxes. Sadly though they are unlikely to be able to get them until after the election.
The other court case has not totally confirmed that Congress can get access to his financial records, it has kicked it back to the original court, but they have made it clear that the president is not totally immune to prosecution which was the main argument Sekulow was making against the records being obtained.
Things slowly closing in on Trump from all directions it seems.... very slowly though sadly.

Peter Theil no longer believes Trump will win reelection and supposedly is distancing himself as such. That may seem inconsequential, but if a guy like Theil believes that, its possible the other technocrats that put Trump there feel the same.

But you cant count out all the judicial/bureaucratic fuckery still in the cards- 'Trump has a plan to remain in the white house, former senator says'. The source on that is suspect, but still a scary read. Cant discount the blatant voter suppression and out right criminality either. The upcoming election should really reveal what forces are pulling the strings right now.

Yeah I saw that plan listed... it sounds way too complicated for Trump to actually think that many steps ahead. But yeah, he's desperate and he will try and cheat somehow for sure.

another issue is voting by mail. with COVID, many more people (maybe even me) will want to vote by mail instead of waiting in lines and doing it in person. some states have rules that votes can only be counted once the polls are closed, which means all the votes cast ahead of time will have to be hand counted that night. if tons of people vote by mail, the decision might not be known right away, could take days to call the winner.

Yeah the mail voting, reduction of places to vote and so on... basically voter suppression in any possible way. Trump has literally admitted that his chances of winning depend on a low turnout.
